Bancroft attorneys Paul Clement, Viet Dinh, and Jeffrey Harris recently published an article entitled “The Constitutional and Historical Foundations of Copyright Protection.”  This paper, published by the Center for Individual Freedom, traces the history of copyright protection going back to 17th-century England, and explains that copyrights have always been seen as inherent property rights that belong to the author or creator.  This understanding of copyright protection directly influenced the founding generation and the Copyright Clause in the U.S. Constitution.  The article concludes that these first principles should be an important component of any policy debates about the scope of copyright protection.
