Risk Management and Compliance

As of October 2016, when the attorneys from Bancroft joined Kirkland & Ellis LLP, they focused on providing strategic counseling to individuals and companies facing substantial, often existential, risk.  Our attorneys have held senior positions in every branch of government, uniquely positioning the Firm to provide effective representation of individuals and businesses before government entities, including Congress, the White House, the Department of Justice, and federal administrative agencies.

We use a multidisciplinary approach through various avenues, different media, and multiple fora to achieve the singular objective of providing enduring solutions to the client’s problems.  From negotiating agreements and managing communications to assisting in preparation for interviews, depositions, and congressional testimony, our team brings to bear a wide range of experience in all facets of government. We have represented a number of corporations and individuals facing government investigations, congressional and regulatory inquiries, and criminal proceedings.  Our clients include corporations, boards of directors, board committees, individual board members, law firms, and senior executives.

We also guide our clients through complex national security issues. We advise international and domestic organizations and individuals on compliance with the USA Patriot Act, the Bank Secrecy Act, U.S. sanctions programs, and related legislation and regulations.  We assist clients in developing and implementing appropriate controls to detect and prevent money laundering, terrorist financing, and other security threats.  We have extensive experience guiding clients through the review process before the Committee on Foreign Investment in the United States—having brought the only challenge to a CFIUS decision and securing a major D.C. Circuit victory that provides important constitutional protections to companies facing CFIUS review.
