NFL Labor Dispute

On July 8, 2011, Bancroft partner Paul D. Clement secured a win for the NFL in its labor dispute with players in the United States Court of Appeals for the Eighth Circuit, 644 F.3d 661 (8th Cir. 2011).  A federal district court had enjoined the NFL clubs from exercising their federal labor law right to lock out the players after the parties’ collective bargaining agreement expired with no new agreement in place.  The Eighth Circuit reversed, adopting the NFL’s argument that the Norris-LaGuardia Act prohibited the district court’s injunction.
